Platinum Performance, Inc. ("Platinum") offers special barn pricing for clients on volume purchases of select Platinum products (the “Products”) (the "Barn Program" or the “Program”). To participate in the Barn Program, clients must comply with the Terms & Conditions governing the Barn Program as set forth herein. By enrolling in the Platinum Barn Program, Platinum Performance® designates the enrollee as an authorized Barn Coordinator (“Coordinator”) for the promotion and facilitation of its animal care and nutritional Products shipped to barn clients and boarders with whom a Coordinator/Barn Member relationship exists (“Member”). By accepting this agreement, the Barn Coordinator accepts this designation solely to solicit and coordinate orders for qualifying Platinum Barn Program sales of the Products.
Platinum reserves the right, to be exercised in its sole discretion, to suspend or disqualify participants in the Barn Program who have violated any of the terms and conditions of these Terms & Conditions. Platinum reserves the right to change the terms or conditions of the Barn Program, in whole or in part, and to terminate the Barn Program, or a client’s enrollment at any time for any reason without prior written notice. Client’s continued participation in the Barn Program constitutes Client’s acceptance of any changes or modifications to the Barn Program.
Client’s participation in the Barn Program shall be governed in all respects by the law of the State of New York, without regard to choice of law provisions. Client agrees that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to your participation in the Barn Program shall be in the state or federal court of competent subject matter jurisdiction in the County of New York in the State of New York.
Eligibility. Clients with a minimum of eight (8) horses or more that are part of a community of horses (a "Barn"), that are residents of the United States or are shipping to a barn or facility in the Unites States and its territories and are at least 18 years of age, are eligible to participate in the Barn Program. Eligible Barn Program communities include the following:
Other horse communities not listed above may be accepted into the Barn Program on a case-by-case basis, in Platinum’s sole discretion. Clients must be residents of the United States or are shipping to a barn or facility in the United States and its territories and are at least 18 years of age, are eligible to participate in the Barn Program. Clients that are enrolled in any of the following Platinum Performance programs are ineligible to participate: Trainers Program, Breeders Program, AAEVT Program, Industry Appreciation Program, Public Service Animal Program, University Program, Veterinary Student Program, Youth Ambassador Program or Sponsored Athletes Program. Participation in another Platinum program not listed here may disqualify client from enrollment, in Platinum’s sole discretion. Wholesalers, distributors and/or resellers are not eligible to participate in the Barn Program. Employees of Platinum, its parents, subsidiaries or affiliates and employees are not eligible to participate in the Barn Program. Any dispute regarding the eligibility of a client will be resolved by Platinum in its sole discretion.
Enrollment. Eligible clients can enroll by registering for an account ("Account") located at [www.platinumperformance.com] ("Website") and submitting an application for the Barn Program(“Barn Member(s)” or “Member(s)”). All Barn Program applications are subject to review and approval to participate in Platinum’s sole discretion. The Member initiating the enrollment process and who will serve as the point of contact with Platinum will be the Barn Coordinator for the Barn. The Barn Coordinator is responsible for ensuring the Barn and its Members are in compliance with the Platinum Barn Program requirements. Barn Administrators will invite each Member to participate in the Program and will facilitate each such Member’s enrollment in the Program by providing the requested information to Platinum, including, but not limited to: contact information, billing information, and individual horse information (e.g., name, age, and recommended Foundation Formula). The Barn Coordinator is also responsible for soliciting, coordinating, and managing the Barn’s Product shipments as needed to help ensure consistent delivery of the Products. The Barn Coordinator will serve as a liaison between Platinum and the Barn Members.

Each Barn may be assigned to a Platinum Barn Manager Advisor as a personal liaison for the Account.
Requirements. To qualify for volume pricing, all orders for Products must be direct from Platinum and placed either on the Platinum Website or with a Platinum Advisor. Each order must also meet the following requirements:

Platinum reserves the right, at its sole and absolute discretion, to cancel, terminate, modify or suspend the Barn Program at any time and for any reason.
Account Access. Once a Barn has been enrolled in the Barn Program, the Coordinator will have access to the “My Barn” section of their account and can view all Members and orders associated with their Barn. The Coordinator will be able to view shipping addresses for Product orders, and modify Auto-Ship dates. The Coordinator will receive updates on all auto-ship orders associated with the Barn and can view Barn Account details. The Coordinator is responsible for maintaining Auto-Ship in accordance with the Colic Coverage Terms & Conditions, if applicable. For the avoidance of doubt, a Coordinator’s adjustment of Auto-Ship dates may deem a horse ineligible for Colic Coverage. If a horse is no longer eligible, Platinum will notify Member of such ineligibility.
Each member is solely responsible for maintaining the confidentiality of the access credentials and other information in connection with his/her Account and will be solely liable for any and all activities under the Account. Members shall be responsible for keeping all Account information up-to-date. Members agree to notify Platinum immediately of any unauthorized or fraudulent use of Barn Coordinator’s Account or any other breach of security or data privacy. Member’s use of the Website is governed by its Terms of Use. Each Member is responsible for remaining knowledgeable on, and in compliance with, the Platinum Website’s Terms of Use.
Confidential Information. The parties will hold in confidence any proprietary or confidential information of the other party, including any information relating to this Agreement, except (i) as otherwise required by law, or (ii) as otherwise authorized in writing by the disclosing party. As a participant in the Platinum Barn Program, Coordinator may receive access to certain personal information of clients, including their name, contact details, and relevant animal care information. This information is provided solely for the purpose of supporting the client’s animal care, coordinating product recommendations and deliveries, and ensuring appropriate follow-up. Coordinator agrees to use this information only for these authorized purposes and to maintain the confidentiality and security of all client data. You may not share, sell, or use client information for any other purpose without the client’s explicit written consent. Misuse of client information may result in removal from the program and potential legal consequences.
Privacy Policy. By registering for an Account, Member agrees to allow Platinum to communicate via mail, email, and through other channels as applicable. Platinum may use these channels to communicate Account status, Account changes, offer special promotions, offers, or offerings that Platinum believes may be of interest to Member. A Member who chooses to opt-out of marketing communications will receive only transactional messages related to his/her Account. Member information will be protected in accordance with Platinum’s Privacy Policy available at: https://www.platinumperformance.com/privacy-center.html.
